Bookings The signing of the Booking Form by the
party leader confirms the acceptance of the terms and conditions
from time to time in force and shall be binding on the head
of the party and all other party members.
No all-male parties or parties of guests
who are all under the age of 21 will be accepted. No pets
accepted. For the comfort of guests this is a no-smoking villa.
To ensure comfort, security and peace of mind our homes are
registered with the State Authorities and are in full compliance
with all relevant legislation.
Rental Period The rental period generally consists
of a Saturday to Saturday booking. however other periods are
occasionally available (please request) Midweek bookings may
incur a 10% surcharge. Stays of 5 nights or less will incur
a cleaning fee of £50.00. The villa is available for
occupation from 16:00 hours, local time, on the day of arrival
until 10:30 hours on the day of departure.
Vacating after 10.30 may incur charges equivalent to one day's
accommodation cost.
Payment A non-refundable deposit of £100.00
is due within 7 days of your initial reservation and is to
accompany the completed Booking Form. On receipt of your deposit
we will bank your cheque and wait for clearance, following
which we will send out a receipt and confirmation of booking.
Please be aware that your booking is not confirmed until such
time as your cheque has cleared.
Payment of the balance, plus the refundable
security deposit is due no later than 8 weeks prior to your
arrival date given in your booking form. On receipt, banking
and clearance of your party's final payment, we will send
out your Arrival Pack.
Please note we are unable to accept credit
or debit card payments. Surcharges levied by Credit Card Companies
would only increase our costs to you our guests.
Security Deposit
All party members are held responsible for
the full extent of any damage or breakages that may be caused
to the villa, its fixtures, fittings and also for any items
in the inventory during your stay.
We require a refundable security/breakage
deposit to be paid at the time final payment is made. This
deposit of £250.00 will be repaid to the head of the
party by cheque, within 30 days of your departure from the
villa, providing the local Management Company have reported
no breakages and you have returned the keys as requested.
We check the inventory prior to your arrival and after your
departure and will advise of any concerns. These may include
additional cleaning costs for spills, stains etc.
We reserve the right to retain the security/breakage
deposit (either in part or full) to cover breakages, damage,
additional cleaning services or non-return of the keys. Receipts
for repairs/replacements will be provided in the unlikely
event that such retention of the security/breakage deposit
is required.
All party members remain liable to the extent
of the cost of the breakages, damages, additional cleaning
services or other losses incurred by the owners as a result
of your occupation the villa which exceed the security/breakage
deposit. This shortfall will be due within 14 days of us notifying
it to the head of the party.
Florida has a sub-tropical climate and care
must be taken with food that is left uncovered. Apart from
spoiling and contaminating, food left uncovered can attract
insects very quickly. Any added costs for pest control services
incurred from lack of care at the villa may be passed to you.
Cancellation by guests
In the event of your needing to cancel the following conditions
will apply.
· More than 8 weeks prior to the arrival
date given on your booking form will result in the loss of
the £100.00 deposit to cover administration costs.
· 5 - 8 weeks prior to the arrival date given on your
booking form will result in the loss of 50% of the total value
set out in your booking form.
· Within 5 weeks of the arrival date given in your
booking form will regrettably result in the loss of the whole
total value as set out in your booking form. (not including
security deposit)
Cancellations of any form can only be accepted
in writing. Cancellation by telephone will not be accepted.
A party who fail to pay their final balance
by the due date, (i.e. 8 weeks prior to arrival), may lose
their booking and deposit. We will send out a reminder for
all booking approx. 1 month prior to the due date. If we do
not receive the payment we endeavour to contact the head of
the party, but if we do not receive payment or communication,
then unfortunately we will cancel the booking and retain the
deposit. If there is a problem, PLEASE CALL US.
We recommend that all party members take
out holiday, injury, medical and cancellation insurance cover
with a reputable insurance company/agent at the time of booking.
Cancellation by Owners
In the unlikely event that circumstances
beyond our control necessitate cancellation of the booking
we will refund any moines paid by the party (without interest,
compensation and consequential loss of any kind). However
the owners will always attempt to satisfy your booking with
a villa of similar or superior standard.
Force Majeure
The owners and their agents accept no responsibility
or liability for any loss or damage or alterations to the
terms of this booking caused by events beyond the owner's
or their agent's control. Including but not restricted to,
war, civil commotion, flight delays or cancellations, technical
difficulties with transportation, alteration or cancellation
of schedules by carriers, adverse weather conditions, fire,
flood, industrial dispute or any other event beyond their
control.
Special Offers and Late Bookings
From time to time a "Special Offer"
may be offered to fill a cancelled or un-booked week. Full
payment of the "Special Offer" rental will be required
with the completed Booking Form in order to confirm the booking.

Safety and Security
Due to State Fire Regulations under no circumstances
may more than the maximum number of persons identified on
the Booking Form occupy the property.
Children must be supervised at ALL TIMES whilst in the pool
area. Glass is NOT permitted in the pool area. Plastic glasses
and plates etc. are provided.
Complaints
In the unlikely event of a problem arising
regarding the villa whilst you are on holiday, immediate contact
should be made with our local Management Company who will
seek to resolve the matter speedily.
Disclaimer
LIABILITY-The
property is privately owned and neither the owners, their
agents nor the Management Company accept any responsibility
whatsoever for personal injury, accidents, loss or damage
to persons or personal effects, however caused.
The owners and their agents reserve the right
of entry at all time. (This includes such workers as pool
maintenance crews and gardeners).
BROCHURE-Whilst
all information supplied in the villa's advertising literature
is deemed to be correct and to the best of our knowledge,
it is understood that the information is for guidance purposes
and does not form part of any contract.
Law
The booking contract is subject to and shall
be construed in accordance with the laws of England and the
parties hereby submit to the exclusive jurisdiction of the
English courts.

All driver's must produce a full valid British
driving licence held for a minimum of one-year, two years
in France and Germany, three years in Cyprus, five years in
South Africa. It is the driver's responsibility to ensure
that they have an appropriate licence. Marsden Villas must
be advised of all endorsements at the time of booking, failure
to do this could result in refusal of the car to the hirer.
All persons driving the vehicle must be in possession of their
driving licence at all time. In Portugal drivers must also
carry photo I.D. or their passport, both must be produced
at the request of the local authority. Also please note that
the car hire company can refuse to provide a vehicle to any
customer who is in their opinion unfit to drive or does not
meet eligibility requirements. In these circumstances your
contract with us will terminate immediately and we will have
no further liability to you. If the hirer has a photocard
licence both parts of the licence must be presented.
Please Note. No refunds will be given for rentals rejected
due to non-production of a valid driver's licence.
Drivers Age
If the driver is under the age of 25 or over
65 years old, please inform us at the time of booking as some
age restrictions may apply in certain destinations. In some
cases a young drivers surcharge may be payable.
What's Included
All rentals include: - Unlimited mileage
(except Canada and Australia) Third party insurance (in the
USA each state establishes a minimum level of third party
cover by law, this can be as low as $5,000. Excess Liability
Insurance (SLI) or Extended Protection (EP) is third party
insurance above the legal minimum increasing cover to $1,000,000
in respect of any claim made against you). Collision Damage
Waiver (CDW) Theft Waiver, Airport Surcharges, Bail Bonds,
All Local Taxes except Australia where taxes are paid locally
by law. The insurance provided by most car rental companies
does not cover tyres, windscreens, the roof, the underside
or interior of the car and towing charges. You therefore may
be liable to any charges to damage to these items. Most car
rental companies also have insurance excess.
What's Not Included
Personal Accident Insurance.
This is probably covered in your holiday insurance. It is
an option, which you will be offered on collecting the car.
Petrol.
Most car rental companies will supply the vehicles with a
full tank of fuel. Cars must be returned full otherwise a
refuelling charge and cost of fuel will be charged locally.
Alternatively in some locations pre-purchase of fuel is compulsory,
please check the petrol policy when collecting the vehicle.
Garaging, Parking and Traffic Fines.
Additional Drivers.
Must be notified at the time of booking and are subject to
additional cost.
Delivery/Collection.
Charges may apply outside office hours even if late collection
is caused by a flight delay. In most locations (not USA or
Canada) deliveries to accommodation can be arranged, although
local charges will apply. Deliveries can only be made to hotels
and apartments.

Insurance Exclusions and Excess
Marsden Villas insurance excess refund policy
will cover you for excess that you may be charged for damage
caused as a result of an accident. Our local supplier may
charge you this excess, but you can reclaim this providing
you complete an accident report form on returning your car
and then forward a copy to Marsden Villas. We will refund
the excess that you have paid within 28 days of receiving
your accident report form. The insurance excess refund policy
does not apply to prestige cars. Insurance does not cover
damage to tyres, windows, the roof, the underside, the interior
of the car, towing charges or damage caused wilfully or recklessly.
You may therefore be liable for the cost of the damage. Insurance
cover is not provided for the contents of the car in the event
of theft. In the event that keys are lost or damaged you will
be liable for reasonable costs for obtaining a replacement.
Additional Drivers
Charges often apply for additional drivers.
Marsden Villas cannot be held responsible for any increase
in charges. Please check additional driver charges at the
time of booking.
Number of Passengers
Car hire companies rental cars are insured
for a maximum number of passengers. Marsden Villas cannot
accept responsibility if the vehicle is not large enough to
fit all passengers and luggage on pick up if incorrect details
were supplied at the time of booking.
Deposit
All clients must produce a valid credit card
in the driver's name as a form of deposit when picking up
the vehicle. Cash deposits are rarely accepted.
Period of Hire
The minimum rental period is one day in the
USA and Canada and three days in Europe. Rental days are calculated
on a 24-hour basis. Most car hire companies have a 59-minute
period of grace, but are not legally obliged to offer this.
After a one-hour period has expired, the rental company may
charge the client for a full day's rental at the vehicles
full charge rate. This rate may be higher than the rate charged
by Marsden Villas. All extensions to the hire period, upgrade
of vehicle, or miscellaneous options or changes to the booking
not advised to Marsden Villas prior to departure from the
UK. must be paid for locally at the time of pick up.
Rental Documents
The rental voucher must be presented when
picking up your rental vehicle. Marsden Villas cannot be held
responsible for rentals rejected if a voucher is not presented.
You should retain your rental documents for a minimum of 28
days after returning home.
Rental Charge
Clients will be charged at the rate prevailing
on the day of collection of the car. No increase or reductions
apply if the rental continues into a higher or lower season
price band.
One Way Rentals
One way rentals are available in most countries
but must be booked and confirmed in advance and may be subject
to a local charge.
Driving Areas
If you plan to drive outside the country
of hire, please notify Marsden Villas at the time of booking.
Local charges may apply.
Amendments, Cancellations and Refunds
There is no charge for amendments or cancellations
requested up to seven days prior to the vehicle pick up date.
A charge may apply for changes made within six days and 48
hours from pick up of your vehicle. All "no shows"
in resort or non-collection of the vehicle or non-release
of the vehicle due to insufficient documentation will be charged
at 50% of the full rental cost. No refunds will be given for
an unused portion of the rental. All vehicles are booked by
group and whilst the car rental company will try to provide
a particular make, they can only guarantee to provide a vehicle
within the group booked. If a car group is unavailable a larger
vehicle will be supplied to the clients. No extra charges
for this service will apply. Vehicles are insured to carry
a maximum number of passengers and must be used accordingly.
If you are dissatisfied in any way with the standard of the
car, you must advise the local supplier immediately. Marsden
Villas cannot accept liability where this procedure is not
followed.
Mechanical Difficulties
In case of breakdown or mechanical difficulties
you must call the car rental company within 24 hours using
the telephone number which appears on the rental agreement.
Authority for repair or replacement must be given by the car
rental company. If you are involved in an accident the local
police and the car rental company must be informed, and a
signed Police report obtained. An accident report form must
be completed by the end of the hire. Full details of third
parties should also be taken. All rental documents should
be retained in the event of an insurance company becoming
involved. Any compensation cannot be considered when this
procedure is not followed. Upon returning the vehicle a checkout
form must be signed. Failure to do this may delay the investigation
of disputes regarding insurance excess charges.
Tax
All taxes are included except those on any
optional extras purchased locally.
Car Type & Suitability
Marsden Villas is unable to guarantee a particular
make or model of vehicle. The vehicle on your voucher is for
guidance only and may be substituted for a similar or upgraded
vehicle (at no extra cost) If you are dissatisfied in any
way with the standard of the vehicle you must inform the local
supplier immediately and Marsden Villas in writing within
28 days of the end of the rental period. The car rental company
will not enter into any discussions regarding customer dissatisfaction
where this procedure is not followed.
Flight Information
For all airport collections, it is essential
that Marsden Villas be given the correct flight number and
arrival time before departure. If the information is not given
in time we will do our best to ensure that the car is available
but no responsibility can be accepted or compensation allowed
for a failed rental due to the rental being classed as "no
show" due to a significant flight delay, or late or incorrect
information from the customer.
Marsden Villas
Marsden Villas acts as an agent for
the car rental company. A contract will be made with the driver
of the vehicle and the car rental company, in the form of
a vehicle rental agreement / contract on collection of the
car. Clients will then be subject to the terms and conditions
of that contract and the law of the country where the rental
has taken place. Marsden Villas is unable to refund any extra
insurance options or local purchases, which you have signed
as accepted on the rental agreement. Marsden Villas accepts
no responsibility for and shall not be liable in respect of
any loss, damage, delays or charges arising from circumstances
out of it's control.
